What to do if you're denied or delayed

OPWDD has real timelines, and you have real rights. Most families who push, in writing, get unstuck.

Documents needed

  • Denial / determination letter
  • All correspondence
  • Original eligibility documents

How to prepare

  1. Read the denial carefully — it includes appeal deadlines.
  2. Decide: Fair Hearing, complaint to OPWDD, or both.
  3. Get help from Parent to Parent of NYS or Disability Rights NY.

What to ask your team

  • Why specifically was this denied?
  • What documentation would reverse this?
  • Can we resubmit instead of appealing?

If you are denied or delayed

  • File for a Fair Hearing within the deadline (usually 60 days).
  • File an OPWDD complaint at https://opwdd.ny.gov.
